Armchair Lifting Accident - Rejected by Other Solicitors Won by Bakers Personal Injury Solicitors

Mr F was employed as an upholsterer when he was injured at work whilst lifting an arm chair from a high stack.

He was going about his job which involved taking a chair from a stack to prepare it for upholstering. The chairs were over stacked, being 5’6” tall, Mr F had to reach over his head to lift the top chair clear of the stack, he then had to walk backwards with the chair before putting it down. This caused Mr F immediate pain down his back.

Mr F reported the incident and was put on light duties. Other personal Injury solicitors rejected Mr F’s claim believing there were little prospects of the claim succeeding. Bakers Solicitors carried out a thorough investigation of the facts surrounding the accident and discovered that no assessment of the risk of physical injury by lifting or carrying the chairs had ever been done by the company.

The only risk the company identified was of the stack toppling over. This was a clear breach of the Manual Handling Regulations.

Mr F’s employers initially denied that they had done anything wrong and refused to compensate him for his injuries. With Bakers Personal Injury Solicitors support, Mr F prepared to issue Court proceedings against the company and when the documents were sent to the defendant insurers, Mr F received an out of court offer which he accepted.
