MOD hearing loss victim gains loss of career damages award during his basic training

Bakers Personal Injury Solicitors settled a significant personal injury case and secured a £265,000.00 compensation package for its client, Mr C, a Coldstream Trainee Guardsman who was exposed to excessive noise whilst undergoing live fire training at a training centre. A claim was pursued against the Ministry of Defence.

Mr C suffered a significant hearing loss; together with tinnitus in his left ear. As a result of these injuries, Mr C has had a considerable change to his life. He no longer enjoys socialising in pubs, clubs or football matches as the noise level is sometimes too great.

After leaving the armed forces he was unemployed for a period of time as his hearing problems rendered him as being unsuitable for many areas of work. He eventually found factory work.

The award was based on the conclusion that the claimants’ employers were negligent and in breach of their statutory duties with regards to the Noise at Work Regulations 1989 and the Provision and Personal Protective Equipment of Work Regulations 2002.
