Restaurant liable for slipping injury

Our client, Mrs P, was visiting a central London restaurant for an appointment with her employers. She had not been to the restaurant before. Mrs P was wearing her usual elegant high heeled shoes and as she crossed the restaurant she slipped and fell to the floor.

Her injuries included some damage to her hip. We were instructed to help Mrs P obtain an award for compensation.Firstly, Mrs P wanted some recognition that it was the restaurant’s fault for having such an unsafe slippery floor. In her instructions she said that it was like a "dance floor".

Secondly, Mrs P wanted an apology as she felt that her pride had been dented and felt really embarrassed.

Upon receipt of the claim the insurers for the restaurant refused to apologise but they did admit legal liability for what happened fairly quickly in the circumstances.

We had some concerns that the insurers might argue that others had not slipped and that it was in some way her fault or that she was wearing the wrong shoes. In the end, our fears were misplaced. After some lengthy medical investigations to make sure that Mrs P’s hip would be alright in the future, we secured a decent award of compensation.
