Slipping accident at work
Mr R from Swindon was at work one morning and needed to go to the toilet. The toilet block at work was situated nearby. Unknown to him, the toilets had recently been cleaned.
The cleaner had not left any warning signs out and as Mr R took two paces into the toilet he slipped and fell heavily onto his shoulder. He picked himself up and went to speak to the foreman. The accident was not recorded at the time. Mr R was still feeling ill later that day and asked to go home early.
After the weekend he tried to work at the factory on Monday and even started Tuesday morning’s shift. By the afternoon he felt that he had to see his doctor. The GP signed Mr R off work for 4 weeks fearing that he had damaged the ‘rotator cuff’ in his shoulder.
Mr R ended up having over three months off work as a result of his injuries. He contacted Bakers Personal Injury Solicitors because he was recommended by one of our existing clients. Upon receipt of the claim for compensation, Mr R’s employer’s insurers argued that the accident was not their fault because the company had not left much water on the floor, and that they had a non-slip floor.
After some discussions we persuaded the insurers that the Work Place Regulations applied and they admitted fault but only subject to Mr R proving the accident happened at work. They argued it had not been recorded. We obtained medical evidence showing that it could only have happened by falling and they paid our client compensation.
