Train Station liable for slip/trip accident
Mr D, from Essex was walking briskly to catch the train at Fenchurch Street Station in London. Like many people, he was running a little late and was trying to get home.
Unfortunately Mr D tripped and fell, injuring his shoulder. When he looked back he saw there was a small tripping hazard raised up from the platform.
We insisted that the loss adjusters offered an amount to pay for the future cost of surgery and also part of Mr D’s Arsenal Season Ticket since he could not get to the game due to his injuries.
Normally, a small hazard like this would not have been an everyday problem but because this was a train station and it is obvious that people have to run for the train, the station owners should have inspected it and repaired the hazard immediately.
However, that was not the main difficulty. The problem Mr D faced was that he did not have any evidence proving the hazard as when he went back to the station to take some photographs immediately afterwards, it had been repaired! Despite this, we managed to win Mr D’s claim.
Mr D sustained a fractured shoulder in the accident and the medical expert advised that he would probably require an operation in the future. We insisted that the loss adjusters offered an amount to pay for the future cost of surgery and also part of Mr D’s Arsenal Season Ticket since he could not get to the game due to his injuries.
In total Mr D received £16,000 compensation in full and final settlement of his claim.
