Work Accident

We were pleased to be able to help Mr R when he was struck in the eye by a stone when working as a gardener for the local Council. In this unusual accident, Mr R had been strimming the grass and was wearing eye goggles to protect himself.

Unfortunately, as he took them off by his van, a stone was thrown up from his colleague’s strimmer and struck him in the eye causing a very serious injury. Mr R was blinded at first but fortunately he received some excellent eye care treatment at the District Hospital.

He made a good recovery but was left with the future risk that his retina might become detached. Bakers Personal Injury Solicitors was asked to help prove that there was breach of the law, including the personal protective equipment regulations.

The Council’s solicitors claimed that it was an accident and tried to prove that their work systems were usually safe. We ran the claim with the backing of a policy of legal expense insurance. The Barrister for the Council conceded legal liability at the doors of the Court and a financial package of nearly £30,000 was secured for Mr R.
